  1. Preparing the Asylum Claim:

    • Collect supporting documentation such as affidavits, witness statements, and relevant reports to strengthen the asylum claim.

  2. Completing the Application Form:
    • Asylum seekers need to complete the necessary application forms provided by Immigration, Refugees, and Citizenship Canada (IRCC).
    • The forms include personal information, details about the asylum seeker’s background, and a comprehensive narrative outlining the reasons for seeking asylum.

  3. Submission of the Application:
    • Submit the completed application, along with supporting documents, to the Immigration and Refugee Board (IRB) through the Refugee Protection Division (RPD).
    • Ensure the application is submitted within the specified time frame.

  4. Screening Interview:
    • Asylum seekers may undergo a screening interview with immigration officials to gather additional information and assess the credibility of the asylum claim.

  5. Refugee Protection Division (RPD) Hearing:
    • If the asylum claim proceeds, a hearing before the Refugee Protection Division (RPD) is scheduled.
    • The asylum seeker, along with legal representation if available, presents their case to the RPD, with the decision based on the information provided and the assessment of credibility.

  6. Decision and Appeal:
    • The RPD renders a decision on the asylum claim. If rejected, the applicant may have the right to appeal to the Refugee Appeal Division (RAD).
    • The appeal process involves a review of the initial decision and the presentation of any additional evidence supporting the asylum claim.

  7. Refugee Status:
    • If the asylum claim is accepted, the individual is granted refugee status in Canada.
    • Refugee status provides protection from deportation and allows the individual to apply for permanent residence in Canada.

Work and Study Permit Options:

As part of the In-Canada Asylum Program, you may also explore opportunities for work and study permits to enhance your experience and contribute to your journey to self-sufficiency. Here’s how:

Get a Work Permit:

  • If you make your claim at a port of entry, you can request to apply for a work permit while with the border services officer. Note that you won’t receive the work permit at the port of entry; it will be issued after completing your medical exam.
  • If you submit your refugee claim online, you can request a work permit in your online application. A work permit will be issued if your claim is eligible to be referred to the IRB and you complete your medical exam.

Get a Study Permit:

  • While you can’t request to apply for a study permit when submitting your refugee claim, you must apply for a study permit separately. Explore eligibility criteria and learn how to apply for a study permit to further your educational pursuits.

Guidance and Legal Support:
Throughout the application process and beyond, asylum seekers are encouraged to seek legal advice and representation for work and study permit applications. Timely and accurate submission of information is crucial for a fair assessment of your claims.
